In the absence of any notice U/Sec. 6 of 3 the Act, without passing final order as per A.P Land Encroachment Act, the Respondent No. 4 is not entitled to interfere with possession and enjoyment of the petitioner.- Admittedly no notice U/Sec. 6 of the Act is issued till date and no order is passed for eviction of the respondent, directing the V.R.O and Revenue Inspector to take possession of the property in terms of provisions of A.P Land Encroachment Act. In the absence of any notice and order, the interference of the 4th respondent with petitioner’s possession and enjoyment is illegal and arbitrary.
